A. LEGAL MANDATE ON THE GRANT OF TRICYCLE FRANCHISE TO QUEZON CITY GOVERNMENT

  • The powers, functions and authority over tricycles-for-hire of the Land Transportation Franchising and Regulatory Board (LTFRB) were transferred and devolved to the Local Government Units (LGUs) pursuant to Republic Act No. 7160 otherwise known as the Local Government Code of 1991.
  • In 1992, the Quezon City Council passed City Ordinance No. SP-15, S-92 entitled, “An Ordinance Franchising and Regulating the Operation of Motorized Tricycles in Quezon City to be known as The "Quezon City Tricycle Ordinance Of 1992” creating the Tricycle Franchising Board (TFB) authorized to issue tricycle franchise to Motorized Tricycle For-Hire and Utility Tricycle Service in Quezon City. It also provides for the general administration, regulation and control over all motorized tricycles operating in Quezon City. The Tricycle Regulation Division (TRD) serves as the implementing arm of the TFB.
  • Guided by the primordial consideration of serving the best interest of the riding public and the tricycle sector, it is imperative for Quezon City to pursue improvements in the regulation of franchising and operations of tricycles thus, the enactment of City Ordinance No. SP- 2337, S-2014 to be known as “An Ordinance Adopting the Quezon City Tricycle Management Code of 2014”

B. COMPOSITION OF THE TRICYCLE FRANCHISING BOARD (TFB)

Chairman - The Chairman of the Committee on Transportation

Member - The Chairman of the Committee on Barangay Affairs and Community Relations

Member - The Head of Transport and Traffic Management Department

Member - The Head of the Tricycle Regulatory Division

Member - The Head of the City Legal Office, or his/her duly authorized representative

Member - A representative from the non-governmental organizations duly accredited by the City Government (to be determined by the City Council)

C. LEGAL MANDATE ON THE GRANT OF TRICYCLE FRANCHISE TO QUEZON CITY GOVERNMENT

  • To issue tricycle franchise and renewal thereof to qualified tricycle operators, upon confirmation by the City Council.
  • To amend, cancel or suspend any franchise/s for any violation of this ordinance, rules and regulations, and implementing guidelines thereof.
  • To prescribe and regulate the zone/area of tricycle operation.
  • To endorse any fare increase for tricycles to the City Council for an appropriate Ordinance.
  • To fix, impose, collect and periodically review reasonable fees and other related charges in the regulation of both motorized tricycle for-hire and utility motorized tricycle but such review shall not be more than once every three (3) years;
  • To issue resolutions and propose amendments to the implementing guidelines pursuant to this Code.
  • To invite erring TODA officers, members, franchisees and all concerned persons when necessary.
  • All matters and issues falling within the jurisdiction of the Tricycle Franchising Board shall be raised before the Board during its regular meetings to be decided or resolved, as the case may be, and indorsed to the City Council for its proper action. NOTE: ALL PETITIONS FOR TRICYCLE FRANCHISE APPROVED BY THE BOARD AND TFB RESOLUTIONS ARE SUBJECT TO CONFIRMATION BY THE CITY COUNCIL THROUGH THE CITY SECRETARY’S OFFICE.

C. TRICYCLE FRANCHISING BOARD ACTIVITY

MEETINGS AND HEARINGS - The Board shall have a regular weekly meeting/hearing (every Thursday). A special meeting of the Board may be called as the need arises.

QUORUM - A majority of the Board or their authorized representatives duly appointed for such purpose in writing signed by the Board member sought to be represented shall be necessary to constitute a quorum. In the absence of the Chairman, members of the Board present can elect among themselves a Chairman. Majority of those present shall be required to render a valid decision.

E. FRANCHISE REGISTRATION

All Public Motorized Tricycles For-Hire and Utility Motorized Tricycle operating within the territorial jurisdiction of Quezon City shall apply for a Franchise with the City Council, through the Tricycle Franchising Board created for the purpose, to operate a motorized tricycle for-hire utility service and register with the Tricycle Regulation Division (TRD) of the Traffic and Transport Management Department (TTMD).

F. REQUIREMENTS FOR APPLICATION OF FRANCHISE FOR PUBLIC MOTORIZED TRICYCLE FOR-HIRE

  • Documents attesting to the applicant's Filipino citizenship.
  • Certification from the Barangay where: a) the applicant is a bonafide resident of the Barangay and a qualified voter within the Quezon City, and the unit applied for is actually operating within the said barangay; or b) In case the TODA where the applicant is a member operates in several contiguous barangays, the clearance may be applied in any of said barangays.   • TODA Clearance issued by their respective president
  • Land Transportation Office (LTO) Certification of Registration (CR) and latest official receipt of registration payment issued in the name of the applicant.
  • Insurance coverage for any liability it may incur to passengers and third parties in case of accidents.
  • Other necessary documents as maybe required by the concerned city government departments.

G. FRANCHISE REGISTRATION

  • Barangay Certificate of Clearance/s in area/s of operation.
  • Land Transportation Office (LTO) Certification of Registration (CR) and Official Receipt (OR) in the name of the applicant.
  • Annual safety inspection report.
  • Business permit issued by the Business Permit and Licensing Office (BPLD) and/or Department of Trade and Industry (DTI) Business Name.
  • Traffic and Transport Management Department (TTMD) Traffic Clearance.
  • Route service map.

H. DURATION/VALIDITY OF FRANCHISE AND PRESCRIBED FEES FOR PUBLIC MOTORIZED TRICYCLE FOR-HIRE AND UTILITY MOTORIZED TRICYCLE RESPECTIVELY

  • PUBLIC MOTORIZED TRICYCLE FOR HIRE - Franchise shall be valid for three (3) years, renewable for the same period. The Franchise Certificate/CPC issued by Tricycle Franchising Board shall be submitted to the Tricycle Regulation Department (TRD) for the corresponding issuance of the Motorized Tricycle Operators Permit (MTOP). The said MTOP should be registered yearly with the TRD and confirmed yearly by the Land Transportation Office (LTO) as For-Hire classification.

  • UTILITY MOTORIZED TRICYCLE- Franchise for utility motorized tricycle shall be valid for one (1) year, renewable yearly. The Franchise Certificate shall be submitted to the TRD for the issuance of the Motorized Tricycle Operators Permit for Utility Service.Utility Service Tricycles shall be registered with the Land Transportation Office (LTO) as Private Classification.

    CONFIRMATION OF UNIT AT LAND TRANSPORTATION OFFICE (LTO)

    Confirmation fee of One Hundred Pesos (P100.00)will be charged when the tricycle operator fails to register the unit within the 30 days prescribed period at the designated LTO agency.

    RENEWAL OF FRANCHISE AND LATE REGISTRATION

    The Tricycle Franchising Board (TFB) shall start to accept renewal of the franchise one (1) month before the date of the expiration. A surcharge of 25% plus 2% interest monthly from the annual supervision and processing fees but not to exceed 36 months shall be collected from the operators with expired franchises who will apply for renewal.

J. AUTHORITY OF THE TRICYCLE FRANCHISING BOARD TO ISSUE/GRANT PEDICAB FRANCHISE

The Quezon City Tricycle Franchising Board (TFB) is authorized to accept applications for accreditation from pedicab associations and applications for pedicab franchises of individual members. The Tricycle Regulation Division (TRD) shall register pedicab franchises and issue the necessary permits for its use (Public Pedicab For Hire, Private Pedicab, and Business Utility Pedicab). The TRD is empowered to supervise, regulate and control the operations of all pedicab operations in Quezon City. The TFB was granted authority to issue franchise as mandated by the Implementing Rules and Regulations Governing Pedicab Operation in Quezon City pursuant toOrdinance No. SP-1104, S-2002 as amended by Ordinance No. SP-2358, S-2014.The ordinance is better known as “The Quezon City Pedicab Ordinance of 2002”.
